If the roads are re-paved with asphalt, would homeowners be allowed to pave their driveways with asphalt?RoadsQuestion from Anonymous · September 12, 2026

The board’s answer

Asphalt is expressly permitted as a driveway material. Article II, Section 2 of the Declaration of Restrictions says driveways "shall be hard-surface (e.g. concrete or asphalt)" and prohibits only gravel. Article I still requires written plan approval from the Association for exterior improvements, which includes driveway repaving.

Is Deer Point a private subdivision?RoadsQuestion from Anonymous · September 12, 2026

The board’s answer

Deer Point is not a private subdivision. The Proprietor's Certificate on Seet 10 of the plat reads, verbatim: "...and that the streets are for the use of the public." The roads are all listed under Road Commission for Oakland County jurisdiction, Act 51 classification "County Sublocal" — certified public county roads. It is also nearly impossible for a public subdivision to become a private subdivision. This is not a realistic approach to fixing/maintaining our roads.
